Ngày 10 tháng 12, 2009, Cộng đồng Việt Nam Bắc California (VAC-NORCAL) đã gửi đến Toà Án Quốc tế về Luật Biển tại Hamburg, Đức quốc (ITLOS) một Đơn kiện Trung Cộng (PRC) về việc Trung Cộng hằng năm ra Lệnh Cấm đánh bắt cá (Fishery Ban) bất hợp pháp trên Biển Đông và việc tàn sát, phá hủy tài sản, phương tiện sinh sống, hạ nhục và bắt giữ trái phép vô cớ ngư dân Việt Nam vô tội khi họ đang hoạt động đánh bắt hải sản sinh sống trong vùng biển Di Sản Việt Nam Cộng Hòa (Bạch Thư VNCH 1975). Trong một sự ngẫu nhiên vì theo đúng thủ tục các điều khoản của Luật biển quốc tế (UNCLOS1982) việc nộp đơn kiện của chúng ta trùng hợp vào mùa Giáng Sinh 2009, và chúng tôi cố gắng sắp xếp sao cho kịp trước đêm Thánh Lễ Giáng Sinh 2009 để phổ biến đến cùng đồng bào Việt Nam khắp nơi trên thế giới để tường.

Kính thưa quý vị,

Vào đêm Giáng Sinh khi người theo Ki tô giáo trên thế giới cầu nguyện cho gia đình, quê hương và hòa bình trên toàn thế giới, thì chính giờ phút ấy quê hưong chúng ta vẫn triền miên ngập tràn nỗi đau khổ vô biên, khi đất nước thân yêu còn nằm dưới gông cùm nô lệ, sự thối nát của tập đoàn thống trị cộng sản và sự nô lệ hèn hạ của chúng trước sự xâm chiếm, cướp đoạt đất đai của Trung Cộng. Còn gì đau khổ hơn khi những ngư dân vô tội Việt Nam đánh bắt hải sản mưu sinh ngay trên vùng biển thân yêu của quê cha đất tổ lại bị Hải quân Trung Cộng bắt bớ đánh đập bắn giết vô cớ, hạ nhục nhân phẩm, phá hủy mọi phương tiện mưu sinh, kể cả các phao cứu sinh chúng cũng đâm lủng bể. Khi những con tàu đánh cá, có khi phải bỏ lại dưới lòng biển khơi, thay vì đem theo cá tôm trở về bến cũ làng xưa thì lại mang về xác chết của những thân nhân trả lại cho gia đình. Con cái, vợ hiền, anh chị, cha mẹ phải nhìn xác họ mà than khóc. Rõ ràng, Trung Cộng đã thực sự hiện nguyên hình những con người dã thú, coi thường tiếng nói lương tâm công chính; Phỉ báng, xem thường luật lệ quốc tế và sự công bằng con người. Sự đau khổ vô cùng ấy thấu đến cả trời cao, bất cứ con người không phân biệt quốc gia, tôn giáo nào, ai còn lương tâm, còn trí óc không thể không chạnh lòng bật khóc.

Mùa Giáng Sinh năm nay, kính xin quý vị không phân biệt tôn giáo, chính kiến hãy cùng dâng lời cầu nguyện cho quê hương, cho đất nước sớm có hoà bình, dân chủ, tự do; Cầu nguyện cho linh hồn các anh hùng Hải quân VNCH đã hy sinh bảo vệ đất đảo Hoàng Sa của chúng ta, xin các Anh linh phò trợ cho công cuộc đấu tranh vì công lý, vì lương tâm và công bằng cho dân tộc. Chúng ta cũng dâng lời cầu nguyện giải thoát những oan hồn của đồng bào ruột thịt đã bỏ xác trong biển Đông khi đi tìm tự do, cầu siêu cho oan hồn 71 lính Hải quân cộng sản Việt Nam đã bị Trung Cộng tàn sát trên bãi đá san hô Garma ngày 14 tháng 3, 1988 và giải oan cho linh hồn tất cả ngư dân Việt Nam vô tội đã bị Trung Cộng tàn sát từ năm 2005 đến 2009 vừa qua.

Những hồi chuông giáo đường đêm Giáng Sinh sẽ mang lời nguyện cầu nồng ấm tình người của chúng ta vang vọng khắp nơi trên hành tinh, đến tận những hang cùng ngõ hẽm, những nơi đèo heo hút gió trên vùng cực bắc, hay đến tận mũi đất cuối cùng của đất nước, đến những thôn, bản làng nghèo khó trên mọi miền cao nguyên giá lạnh, đến những hải đảo xa xôi nhất của tổ quốc, lời cầu nguyện của chúng ta cũng sẽ đem lại an ủi cho từng người Việt Nam sống xa xứ còn nặng hoài bão cho quê hương ngời sáng; Và đến những ai còn đang bị giam cầm trong các trại tù cộng sản vì bất đồng chính kiến, cùng xót thương cho những linh hồn oan khiên người Việt chết thảm trên Biển Đông vì bạo lực và gian ác.

Văn kiện lịch sử VAC-NORCAL gửi Toà Án Quốc Tế về Luật Biển ngày 10 tháng 12, 2009 đánh dấu một chuyển hướng đấu tranh vì tự do dân chủ cho quê hương Việt Nam. Nó thể hiện một sự thách thức ngoại giao trước quốc tế về sự tồn tại của một thực tế Việt Nam Cộng Hòa và thực thể bạo lực cộng sản Việt Nam hiện nay. Nó chứng minh sự kiên trì của những người con thân yêu của Việt Nam vẫn luôn ngưỡng mộ sự hy sinh cao cả của những chiến sĩ Hải quân VNCH và trên hết luôn noi theo tấm gương trung trinh tiết liệt của những anh hùng tên tuổi hay vô danh đã tuẫn tiết trong bất cứ không gian thời gian nào để các thế hệ mai sau noi theo sự hy sinh vì lòng yêu nước và công chính của họ. Chúng ta luôn tôn kính sự hy sinh cao cả đó.

Sự hy sinh cao cả đó là sức mạnh quật ngã tất cả mọi quyền lực dựa trên gian ác, khủng bố và bạo lực mà cộng sản VN đang thực hiện tại quê hương. Sự hy sinh cao cả đó là thước đo lòng tốt, sự bao dung, rộng lượng của chúng ta đối với ngay chính kẻ thù của chúng ta dưới các điều kiện công lý và luật pháp. Và sau cùng sự hy sinh cao cả đó là kim chỉ nam, là phương hướng trong đêm tối của lịch sử giúp chúng ta vượt qua mọi khó khăn để thu hồi lại sự toàn vẹn lãnh thổ và danh dự cho quê hương dân tộc.

Chúng ta cùng dâng lời cầu nguyện trong khát vọng để mùa Giáng Sinh hôm nay và kế tiếp, để đất nước chúng ta sẽ trở về lại với chúng ta, toàn dân Việt sẽ tràn ngập hạnh phúc ấm no và phú cường trong nền dân chủ công chính.

Dear President and Members of the International Tribunal for the Law of the Sea (ITLOS):

On behalf of the Vietnamese American Community of Northern California (VAC-NORCAL), I convey the voice and the will of the Vietnamese Community members to you and the members of the ITLOS our deepest and most sincere thanks for your time reading our VAC-NORCAL’s Statement of Claim and Request for ITLOS’ prescription for the provisional measures for the urgency of the status in the East Sea.

Mr. President and members of the ITLOS,
I take this opportunity to express and consolidate our community’s expectation for the peace, the conscience, and the trustworthiness that the ITLOS has been carrying out its mission for years to settle the sea disputes among the coastal States. VAC-NORCAL is not a State, it did not sign in the UNCLOS 1982; however, inherited the political tradition and legitimate civic procedures of the Republic of Viet Nam (RVN), VAC-NORCAL believes that the ITLOS will accept our Statement of Claim and Request for provisional measures for the urgent state of the East Sea.

The dispute of the East Sea between the PRC and the RVN began in 1974 when the People’s Liberation Navy (PLAN) attacked and seized the Paracel islands on January 19, 1974. Consequently, The Foreign Affair Ministry of The RVN government instantly issued the Proclamation of the RVN Sovereignty in the East Sea and the two archipelagoes and published its White Book in 1975. The historic documents were welcomed and supported by the RVN’s friendly states all over the world. However, the state of the East Sea becomes worse and worse, and today the PRC considered its sovereignty over the East Sea and arrogantly announced the annexation of the two archipelagoes into Hainan provincial administrative system. Furthermore, the PLA issued the fishery ban every year from June to August and deliberately killed the innocent Vietnamese fishermen even they were fishing in their territorial sea. The killings of the Vietnamese innocent fishermen originated from the disputes over the East Sea and the two archipelagoes that the PRC aggressively seized from the Vietnamese people who can prove their undisputable sovereignty by historic documents and artifacts. The killings of the Vietnamese innocent fishermen are unbearable and so painful that nobody who has a little conscience can accept the wrongful deeds of the PLA. That is why VAC-NORCAL has to recourse to the ITLOS for help, and calls upon the international communities and the UN organizations to support us.

Mr. President and members of the ITLOS, we believe that for the sake of the human goodness, the human precious values, the human conscience and morality, the ITLOS will consider our Statement of Claim and the Request for provisional measures for the East Sea in its urgent state.

VAC-NORCAL avails itself of this opportunity to renew its highest honor and respect to Mr. President and the members of the ITLOS.

REQUEST FOR PROVISIONAL MEASURES

1.1. Pursuant to Article 290(5) of the United Nations Convention on the Law of the Sea (‘the 1982 Convention’), VAC-NORCAL requests that the International Tribunal for the Law of the Sea (‘the ITLOS’) prescribe the provisional measures specified below in VAC-NORCAL’s dispute with The People’s Republic of China (‘PRC’) over the PRC’s Fishery Ban and the Killings of the innocent Vietnamese fishermen inclusive of the disputes over the East Sea and the Paracel and Spratly archipelagos.

2. VAC-NORCAL has requested the submission of its dispute with the PRC to an arbitral tribunal established under Annex VII of the Convention by written notification in the form of a diplomatic Notes conveyed to the PRC Consulate General in San Francisco on 5 August 2009 (Annex A), and to the PRC Consulate General in New York on 3 September, 2009 (Annex B), the third diplomatic note by email to the PRC-MFA Web site and main news agencies on 01 October, 2009 (Annex C), and the Final diplomatic note by email to the PRC-MFA Web site and main news agencies on 13 November, 2009 (Annex D). The written notifications was accompanied by a statement of VAC-NORCAL’s claim and the grounds upon which it is based in accordance with Annex VII, Article 1 (“the Statement of Claim”) (Annex E).

THE FACTS

3.2. The facts of the dispute are as set out in the VAC-NORCAL’s Statement of Claim.

4.3. The history of the dispute is set out in section 1 The Reason and Submission of the VAC-NORCAL’s Statement of Claim, and may be traced from the correspondence which is set out in Annex E.

4.4. Following the deadly incidents after the PRC’s fishery ban order in the East Sea , on 5 August 2009 , VAC-NORCAL sent a diplomatic Note to the PRC Consulate General in San Francisco , the full text of which is finally updated and emailed to the PRC’s Web site and main news agencies on 13 November, 2009 at Annex E. That Note reads as follows:

Dear Foreign Minister:

On October 3, 2009 , VAC-NORCAL sent the PRC-MFA a Diplomatic Note in which we believe that you would have it through the PRC-MFA Web site address and the operator of SINANEWS.com conveyance. VAC-NORCAL would like to send you the fourth Diplomatic Note today November 12, 2009 to reaffirm that VAC-NORCAL has done everything to contact PRC-MFA and to prove that all means has been searched to invite PRC-MFA to negotiate the current situation of the East Sea .

This VAC-NORCAL’s Diplomatic Note on November 12, 2009 is to re-affirm VAC-NORCAL’s sovereignty in the East Sea in accordance with the heritage and historic and political documents we have inherited from the Republic of Vietnam . We include herein the previous Diplomatic Note on October 3, 2009 as well as the Statement VAC-NORCAL’s claims, the appendices 1, and 2 about the Proclamation of the Urgent Status in the East Sea and the Table of the Estimate Damages and Losses caused by the PRC to the Vietnamese people in the East Sea through many years since 1974.

VAC-NORCAL believes that we shall have your attention and your reply as soon as possible to this Diplomatic Note. VAC-NORCAL is entitled to seek a remedy, including by way of ITLOS provisional measures. Nonetheless, VAC-NORCAL is willing to make one last attempt to find out peaceful ways to resolve the issue. VAC-NORCAL is ready to hold any negotiation conference with the PRC-MFA to resolve the killings of the Vietnamese innocent fishermen in the East Sea as well as other issues.

VAC-NORCAL accordingly calls upon the government of the PRC to indicate forthwith its proposed bilateral agreement:

  1. To suspend indefinitely all plans and schemes of building and transforming the natural rocks, reef, or islands into military bases for the war purpose; causing harms to the maritime environment.
  2. To end the killings and shootings that aim directly to the Vietnamese innocent fishermen.
  3. To compensate the damages and losses the Vietnamese victims suffered for years.
  4. It is essential that the PRC should stop immediately any proceedings to the installation of news devices and war exercises while the negotiation is proceeding.

This proposal is made without prejudice to the legal positions of VAC-NORCAL and the PRC.

VAC-NORCAL avails itself of this opportunity to renew to the Government of the PRC the assurances of its highest consideration.

6. At the time that Note was delivered, VAC-NORCAL indicated that this is the last attempt to find a bilateral settlement relating the dispute and an early reply would be appreciated, but no specific date was indicated in the Note

7. As of December 6, 2009 , VAC-NORCAL has not received the PRC’s response to its diplomatic Note.

THE JURISDICTION AND ADMISSIBILITY

8. The Socialist Republic of Vietnam (SRV) which annexed the Republic of Vietnam (RVN) into the Democratic Republic of Vietnam (DRV) after the successful invasion in 1975 has executed illegitimate procedures to violate the international law by breaking the Paris Accord 1973. The illegal annexation which the SRV propagated as a re-unification does not represent the total Vietnamese people’s voice and approval. The SRV Congress is not composed of the Vietnamese deputies through clean and open and fair elections. The SRV’s Constitution does not represent the will of the Vietnamese people and thus, the jurisdiction that sets out the limits and power does not reflect the Vietnamese people’s approval. The treaties the SRV signed with other coastal states; therefore, are to be re-examined by the Vietnamese people when a new political regime by the people and for the people comes to substitute the SRV administrative system.

9. VAC-NORCAL is the Vietnamese American Community of Northern California in the USA and is one of many Vietnamese communities around the world who declined the communism and inherited the RVN’s political and civic heritage. VAC-NORCAL is non-beneficial, non-profit, independent, and mutual assistant among its volunteered-members. VAC-NORCAL is not a government, a state, or any administrative system working for another country, but is part of American society under the law, and abides to the law of the US government. However, because its heritage is the RVN’s political backgrounds such as democracy and freedom and human rights, VAC-NORCAL believes that calling upon the international organizations to support its just cause and for the human conscience to stop the PLAN’s wrongful deeds killing the Vietnamese innocent fishermen in the East Sea is the demonstration of the continuing heritage of the RVN, a de facto, that was destroyed by the SRV’s illegitimate invasion in 1975 and is the verity, the human conscience that nobody can deny.

Inherited the RVN’s political and civic heritage; consequently, VAC-NORCAL has its jurisdiction and authority over the sea and land issues of Vietnam and legally calls upon the international organizations for full consideration of its sovereignty requests.

VAC-NORCAL believes that its Request for a prescription of the Provisional Measures from ITLOS versus the PRC’s wrongful deeds killing the Vietnamese innocent fishermen is admissible by the ITLOS.

REQUEST FOR PROVISIONAL MEASURES

9. In its Note of 23 November 2009 , VAC-NORCAL requested that, pending the constitution of the Arbitral Tribunal under Annex VII, it will request the Tribunal’s prescription for provisional measures specified in the Note and repeated in section 3 Conclusion of the Statement of Claim. Indeed, the PRC denied all Notes VAC-NORCAL sent to them on this issue. PRC’s denials are contrasted with all foreign affairs speeches the PRC’s officials used to state that the East Sea dispute should be settled bilaterally between PRC and another coastal State.

10. VAC-NORCAL’s aim has throughout been to seek to establish a proper system of consultation, notification and exchange of information with respect to the major points set out in the Statement of Claim. In an attempt to advance this aim, it agreed to a meeting with the PRC to settle the disputes in the East Sea in order that the fishery ban order will be lifted, but the PRC denied the request

11. Considerably more than two weeks having elapsed since the date on which VAC-NORCAL made its request to the PRC for provisional measures, and no agreement having been reached between the parties either as to the substance of the provisional measures sought or as to the procedure to be followed, in accordance with Article 290(5) of UNCLOS, VAC-NORCAL submits its request for provisional measures to the Tribunal.

PROVISIONAL MEASURES REQUESTED

13. Pending the constitution of the Arbitral Tribunal, VAC-NORCAL requests that the Tribunal prescribe the following provisional measures:

  1. The PRC stops immediately their illegal fishery ban, removes immediately all installations of naval ports, bases for the military activities in the East Sea and while the East Sea is the Vietnamese sovereign sea, and return to the Vietnamese people.
  2. The People’s Liberation Army Navy (‘PLAN’) is responsible for all killings they have done to the Vietnamese people, damaging of their ships and properties, leaving never-healed wounds on their bodies or in their souls of all Vietnamese victims, thus lead to painful living conditions and cause harm to marine environment since the PRC proceeded their illegal aggressive wars in 1974. Compensation thereof the PRC must be responsible for the damages of the natural resources, loss of lives, the marine environment destruction on the Paracel and Spratly archipelagoes of the East Sea by the Chinese installing their military bases, the cost evaluated from Jan 19, 1974 up to now 2009 when the Vietnamese people lost these islands and the East Sea . VAC-NORCAL calls for the PRC to negotiate bi-laterally to settle peacefully the disputes of the East Sea pursuant to the spirit of UN Charter and UNCLOS 1982.
  3. The PRC is responsible for all deaths, costs and damages they have done to the Vietnamese people and the natural resources they destroyed or removed on the islands and the East Sea since January 19, 1974 .
  4. The PRC is responsible for all cost and expenses incurred by VAC-NORCAL’s submission of this package and all of VAC-NORCAL’s related legal procedures including but not limiting to the expense for the judges and lawyers before the Tribunal to the finish of the case.

THE REASONS FOR WHICH THE REQUEST IS MADE

14. The reason for requesting provisional measures is that the PRC’s action in engaging in military build ups in the Paracel and Spratly archipelagoes is causing and has the potential to cause serious and irreversible damages to the marine environment and serious prejudice to the rights of VAC-NORCAL. The PRC’s military build-ups are evidently intended to be permanently and fixed involved military activities to make the construction irreversible and the natural forms of the Vietnamese islands irreparable. The PRC also destroyed the Vietnamese natural resources, historic artifacts, landmarks and monuments and caused harms to the natural amenities on these islands.

15. The Fishery ban issued by the PRC and the killings of the innocent Vietnamese fishermen continues year after year in the East Sea , the death toll is not sufficiently confirmed yet. In 1988 the PLAN massacred 71 Vietnamese people on Garma island of the Mischiefs reef in the Spratly archipelago. In 1974 the PLA killed 54 Republic of Vietnam Navy soldiers on the Paracel archipelagos.

16. Under Article 290(1), as applied to the present application by Article 290(5), the Tribunal “may prescribe any provisional measures which it considers appropriate under the circumstances to preserve the respective rights of the parties to the dispute or to prevent serious harm to the marine environment”. Both conditions for the prescription of provisional measures exist here.

(a) Serious harm to the marine environment

17. The VAC-NORCAL’s concerns about the reliable source of news and its reports The Urgency of the State of the East Sea annexed to the Statement of Claim, to which the Tribunal is respectfully referred, demonstrate that the structures of the PRC’s military and naval bases on the two archipelagos are causing and threatening to cause harm to the marine environment, producing major changes to the shape of the islands, changes in natural resources and migrating the Chinese people come to dwell on the Vietnamese islands, the PRC’s activities consequentially impact the social and political Vietnamese history and effect the Vietnamese coastal navigation and access to the East to the Pacific Ocean.

(b) Prejudice to the rights of VAC-NORCAL under UNCLOS

18. The rights of the VAC-NORCAL which it seeks to preserve by the grant of provisional measures are those relating to the maintenance of the marine and coastal environment and the preservation of its rights of maritime access to its coastline, in particular via the eastern entrance of the Pacific Ocean and the coastal states which is the main sea line to support the survival of the Vietnamese fishermen in their sovereignty East Sea.

POSSIBLE CONSEQUENCES OF NOT GRANTING PROVISIONAL MEASURES

20. VAC-NORCAL believes that provisional measures are necessary to ensure that any final decision of the Annex VII Arbitral Tribunal can be implemented effectively and is not meaningless. A failure to prescribe provisional measures would prejudice the rights of the Vietnamese people.

THE URGENCY OF THE SITUATION

22. The situation is urgent because it takes some time the Annex VII Arbitral Tribunal will be established and able to decide the provisional measures for this case. The PRC has not responded to VAC-NORCAL’s diplomatic Notes so far, and the situation gets worse and worse while the PRC continues their naval power to fortify their occupation on the Vietnamese islands.

PRIMA FACIE JURISDICTION OF ANNEX VII TRIBUNAL

23. VAC-NORCAL is not a party to UNCLOS. The Tribunal may prescribe provisional measures if, inter alia, it considers that, prima facie, the tribunal to be constituted would have jurisdiction pursuant to Article 290(5) of UNCLOS. An Arbitral Tribunal constituted pursuant to Annex VII would have jurisdiction over this dispute pursuant to Article 288(1) of UNCLOS.

24. UNCLOS Part XV Section 2 provides a mechanism by which a party may invoke compulsory procedures for the resolution of the dispute where no settlement has been reached by recourse to Part XV section 1. Article 286 permits these compulsory procedures to be invoked by any party to the dispute by submitting the dispute to a court or tribunal having jurisdiction under section 2.

25. VAC-NORCAL’s dispute with the PRC also concerns the interpretation or application of UNCLOS. Relevant provisions of UNCLOS have been raised consistently in diplomatic Notes with the PRC since the commencement of this dispute. As VAC-NORCAL has not made a written declaration pursuant to Article 287(1), VAC-NORCAL is deemed by operation of Article 287(3) to have accepted arbitration in accordance with Annex VII as the means of settling disputes between VAC-NORCAL and the PRC concerning the interpretation or application of UNCLOS.

27. UNCLOS Article 286 also provides that a dispute can only be submitted at the request of any party to the court or Tribunal having jurisdiction under Part XV Section 2 where no settlement has been reached by recourse to Part XV Section 1. That condition is met in the present case.

Đây là văn kiện bán nước do Phạm Văn Đồng ký năm 1958. May mắn thay, văn bản nầy không có hiệu lưc. Vì 2 quần đảo Hoàng Sa và Trường Sa nằm ở phía Nam vỉ tuyến 17, nên vào thời điểm trên, các quần đảo nầy thuộc lãnh thổ Việt Nam Cộng Hòa. Việt Cộng không có thẩm quyền trên 2 hòn đảo quý của đất nước, chúng không có quyền bán hay nhượng lại cho bất kỳ thế lực ngoại bang nào.


Bốn chiến hạm của quân lực Việt Nam Cộng Hòa đã tham dự trận hải chiến Hoàng Sa bảo vệ lãnh thổ vào năm 1974. Chiến hạm HQ-10 trúng đạn vào pháo tháp bị chìm tại trận, chiến hạm HQ-16 bị hư hại nặng nghiêng 15 độ, chiến hạm HQ-5 và HQ-4 bị hư nhẹ. Gần 50 thủy thủ và hạm trưởng Ngụy Văn Thà của HQ-10 tử vong. Ngoài ra HQ-5 có 3 quân nhân tử vong và 16 bị thương.
